Commission

What percentage, what it's calculated on (gross or net), on which income (all of it or only what the agency brings in) and when it's settled. See how much an agency charges.

Duration and exit

How long it lasts, whether it auto-renews and, above all, how it ends: how much notice and whether there are penalties. Be wary of contracts with no way out or huge penalties.

The account is yours

It must be clear that the account, email, socials and payouts are yours, and that they're handed back if you leave.

Included services

Exactly what the agency does: strategy, messaging, marketing, privacy, reporting. If it isn't written, it isn't included.

Exclusivity

If they ask you to work only with them, it should be reasonable and for a defined period.

Confidentiality and content

A commitment not to share your data or content, and what happens to the content if you leave.

Your limits

Your content limits in writing, with the agency committed to respecting them.

Before you sign

Read it all, ask about anything unclear and, if in doubt, talk to a lawyer: this guide isn't legal advice. At Elaia we review the offer with you before you sign.

Frequently asked questions

Is it normal to sign a contract with an agency?
